1. About These Terms

These terms govern your use of this website and any purchase you make from it. By placing an order, you agree to these terms. If you don’t agree, please don’t purchase.

This site is operated by Marion Merle trading as Atelier Merle, based in Kelvedon, United Kingdom.

2. Products

Original paintings are one-of-a-kind artworks. All sales are final once shipped (see Section 5).

Prints are reproductions of original works. Open edition prints are unlimited runs. Limited edition prints are numbered, signed, and include a certificate of authenticity.

Commissions are bespoke works created to your brief. See Section 7.

Colours may vary slightly from screen to screen. I photograph work carefully but cannot guarantee exact colour matching on your display.

3. Pricing & Payment

All prices are in GBP (£) and include VAT where applicable.

Payment is taken in full at checkout for prints and originals.

I reserve the right to change prices at any time. The price at the time of your order is the price you pay.

4. Shipping

I ship originals from Kelvedon using Parcelforce. Estimated dispatch times:

• Originals: 5–10 business days - Free UK Delivery

• Commissions: as agreed in writing - Free UK Delivery

Prodigi ships giclée fine art print from several locations. Estimated dispatch times:

• Prints: 3–7 business days

Shipping is tracked. You’ll receive a tracking number by email once dispatched.

International orders: You are responsible for any customs duties or import taxes charged by your country. I cannot mark orders as gifts to avoid these.

I am not responsible for delays caused by couriers or customs.

5. Returns & Refunds

Prints: You have 14 days from receipt to return an undamaged print for a refund, in line with UK Consumer Contracts Regulations. Return postage is at your cost. Original postage is non-refundable.

Original paintings: Due to their one-of-a-kind nature, originals are non-refundable unless they arrive damaged.

Damaged on arrival: If your order arrives damaged, contact me within 48 hours with photos. I’ll arrange a replacement or refund.

Commissions: Non-refundable once work has begun (see Section 7).

6. Intellectual Property

I retain full copyright of all artwork I create, including originals, prints, and commissions.

Purchasing a work gives you the right to display it privately. It does not give you the right to reproduce, sell, or use the image commercially without my written permission.

If you’d like to license an image (for print, merchandise, editorial, etc.), contact me to discuss terms.

7. Commissions

Commission enquiries are accepted by email or via the contact form. A commission is confirmed only when:

• A written brief has been agreed

• A 50% non-refundable deposit has been received

The deposit covers my time and materials. It is non-refundable if you cancel after work begins.

I’ll provide 1–2 work-in-progress images for your feedback. One round of major revisions is included.

The remaining 50% is due before the work is shipped. I retain copyright of commission work (see Section 6).

Completion time is approximately 3–6 weeks from deposit receipt. I’ll confirm a timeline in writing before starting.

8. Limitation of Liability

To the fullest extent permitted by UK law, my liability to you is limited to the amount you paid for the order in question. I’m not liable for indirect losses, loss of enjoyment, or losses you suffer because of third parties (e.g. couriers).

Nothing in these terms removes your statutory rights as a UK consumer.

9. Privacy

Your data is processed in accordance with my Privacy Policy [link]. I use your email and address only to fulfil your order. I won’t sell your data.

10. Disputes

I’ll always try to resolve issues directly. Email me first: hello@ateliermerle.co.uk.

These terms are governed by the laws of England and Wales.
